Acceptance of T&C
United World Wrestling, a company located at Rue du Château 6, 1804
Corsier-sur-Vevey Switzerland,
registered under CHE-108.227.795 (“UWW”, “we”, “us”, “our”) provides its
services to you (“you” or
“User”) through its website and platform located at https://uww.org/ (the
“Platform”). Your access
to the Platform is conditional upon your acceptance of and compliance with
the following Terms and
Conditions (the “T&C”). By using or accessing the Platform, you acknowledge
that you have read
understood and that you agree to these T&C.
The Privacy Policy, the Cookie Policy and all such additional terms,
guidelines, and rules as set
forth on the Platform are hereby incorporated by reference into these T&C
and expressly agreed to
and acknowledged by the User. If you do not agree with these T&C do not
access the Platform.
We reserve the right, at our sole discretion, to amend these T&C at any
time. If we do this, we
will post the changes on this page and will indicate at the top of this page
the date these Terms
were last revised. We will also notify you, either through the Platform user
interface, in an
email notification or through other reasonable means. The most current
version of the T&C is
available at all times on the Platform. The continued use of this Platform
following any such
changes shall constitute your acceptance of such changes.
Personal data and registration
Anyone can browse the Platform without registering for an account. Certain
areas of the Platform
will require you to create an account (“Account”) in order to access certain
services of the
Platform. In this case, you agree to provide and maintain true, accurate,
current, and complete
information about yourself (the “Registration Data”).
Minors are not allowed to use the services without the consent of their
parents or legal
guardians. They must obtain such consent before providing any personal data.
As Parents or legal
guardians, it is solely your responsibility to determine whether any of the
Platform content
offered through the Platform and any other material on the Platform are
appropriate for your
child. Parents who allow their children access to the Platform should assist
them in setting up
any relevant accounts and supervise their access to the Platform.
Should we have reasonable grounds to suspect that you have provided untrue,
inaccurate, not
current or incomplete information or that you didn’t comply with any
provision of the T&C, we may
refuse to accept any application for an Account registration, or may suspend
or may cancel any
Account registration, in our sole discretion. Your access and use of the
Platform may also be
interrupted or suspended from time to time for any reason, including,
without limitation,
technical issues, periodic updating, maintenance or repair of the services
or any other actions
that we, in our sole discretion, may decide to take.
You are not authorized to, and warrant that you will not, access or use the
Platform (i) in
violation of any applicable law, regulation or court order, (ii) in
violation of any third party
rights, (iii) to attempt to gain unauthorized access to or disrupt services,
devices, (iii) to
attempt to gain unauthorized access to or disrupt services, devices, data or
accounts, (iv) to
distribute malicious code, (v) in a manner that may damage the Platform or
interfere with another
User’s use of the Platform, (vi) to assist or encourage any person to
perform any of the
foregoing.
Account
When you create an Account, you will receive a password and Account
designation upon completing
any registration process. Your Account is strictly personal. You are
responsible for maintaining
the confidentiality of the password and Account information and are fully
responsible for all
activities that occur under your password or Account and acknowledge and
agree that you are and
will be solely liable for any and all acts and omissions under your Account,
including any content
that is posted or transmitted using the Platform.
Without limiting the foregoing, you agree to use reasonable efforts to
prevent unauthorized access
to or use of your Account and to preserve the confidentiality of your
username and password.
You agree to notify us immediately of any unauthorized use of your Account
or any other breach of
security of which you become aware. You will be solely responsible for
losses and damages incurred
by us and others due to any unauthorized use of your Account. At the end of
each session, you will
ensure that you log out of your Account.
Restrictions to the use of to the Platform
You may not and shall not use the Platform and the Platform services to (i)
license, sublicense,
sell, resell, rent, lease, transfer, assign, distribute, time share or
otherwise commercially
exploit or make the Platform or Platform services available to any third
party, except if/as
otherwise expressly set forth in these T&C, (ii) to harass, threaten or
cause damage or injury to
any person or property; (iii) to publish, send or store any material that is
infringing, false,
defamatory, obscene, pornographic, hateful, racially or ethnically
offensive, or encourages
conduct that would be considered a criminal offence, give rise to civil
liability, does not comply
with any law, or is otherwise inappropriate or otherwise illegal or tortious
or that violates any
privacy rights (iv) post advertisements or solicitations of business; (v)
impersonate another
person (vi) send or store malicious code; (vii) upload or distribute, in any
way, any files that
contain a virus, corrupted file, or any other similar program software that
may damage the
operation of UWWs ; or (viii) use any device, software or routine to, or to
attempt to, or
otherwise attempt to, interfere with the proper functioning of the Platform
or Platform services.
In particular, when you upload material to the Platform or make contact with
other Users of the
Platform, you shall you agree that you will not (i) submit material that is
subject to copyright
laws, protected by trade secret or otherwise subject to third party
intellectual property or any
other proprietary rights unless you are the owner of such rights or have
permission from their
rightful owner to post the material and to grant us all of the license
rights granted herein. We
expressly disclaim any and all liability in connection with your uploaded
material. You shall be
solely responsible for your own material uploads and the consequences of
uploading them.
At sour sole and entire discretion, we have the right to remove any material
uploaded by you and
terminate your access to the Platform without notice if, in our opinion,
such material does not
comply with any provision of these T&C. You acknowledge that we have the
right to disclose your
identity to any third party who claims that any of your uploaded material
infringes their
intellectual property rights, or their right to privacy, or to regulatory or
law enforcement or
other state authorities.
Subscriptions, billing and cancellation
UWW offers a subscription service that allows you to access

Types of memberships
We offer a few types of membership plans with differing conditions and
limitations free,
pay-per-view, subscription, and rental.
You must provide us with a current, valid, accepted method of payment (as
such may be updated from
time to time, "Payment Method") to use the services. We will bill the
monthly membership fee to
your Payment Method. You must cancel your membership before it renews each
month in order to avoid
billing of the next month's membership fees to your Payment Method.
Billing
By starting your membership, you authorize us to charge you a monthly
membership fee at the then
current rate, and any other charges you may incur in connection with your
use of services to your
Payment Method.
We expressly reserve the right to adjust pricing for our service. Except as
otherwise expressly
provided for in these T&C, any price changes to your service will take
effect following e-mail
notice to you.
The membership fee for our service will be billed at the beginning of the
paying portion of your
membership and each month thereafter unless and until you cancel your
membership. We automatically
bill your Payment Method each month on the calendar day corresponding to the
commencement of your
paying membership.
Payments are non-refundable and there are no refunds or credits for
partially used periods.
Cancellation
You may cancel your membership at any time, and you will continue to have
access to the service
through the end of your monthly billing period.
Third Party Content
The Platform may include hyperlinks to other Platform, products, services,
content, promotions
and/ or resources (collectively “Third Party Content”), which are provided
solely as a convenience
to you. You acknowledge and agree that we have no control over, and are not
responsible for, any
Third Party Content, and that we do not endorse any advertising, products,
services or other
materials on or made available from any Third Party Content.
Furthermore, you acknowledge and agree that we are not liable, directly or
indirectly, for any
loss or damage, caused or alleged to be caused, or which may be incurred, as
a result of the
availability or unavailability of any Third Party Content, including as a
result of any use of, or
reliance placed by you upon, any Third Party Content or any advertising,
promotions, resources,
services, content, products or other materials on, or made available from,
any Third Party Content
(or the completeness or accuracy thereof).
Limitation of liability
By agreeing to these T&C and accessing the services, you agree, to the
fullest extent permitted by
applicable law, to indemnify, defend, and hold harmless UWW, and our
respective past, present, and
future employees, officers, directors, contractors, consultants, equity
holders, suppliers,
vendors, service providers, parent companies, subsidiaries, affiliates,
agents, representatives,
predecessors, successors, and assigns (individually and collectively, the
“UWW Parties”), from and
against all actual or alleged claims, damages, awards, judgments, losses,
liabilities,
obligations, penalties, interest, fees, expenses, and costs (including,
without limitation, court
costs, costs of settlement, and costs of pursuing indemnification and
insurance), of every kind
and nature whatsoever, whether known or unknown, in law or equity, whether
in tort, contract, or
otherwise (collectively, “Claims”), including, but not limited to, damages
to property or personal
injury, that are caused by, arise out of or are related to (a) your use or
misuse of the services
(b) your violation or breach of any term of these T&C or applicable law, and
(c) your violation of
the rights of or obligations to a third party, including another user or
third-party, and (d) your
negligence or willful misconduct. You agree to promptly notify us of any
Claims and cooperate with
the UWW Parties in defending such Claims. You further agree that the UWW
Parties shall have
control of the defense or settlement of any Claims.
UWW shall not be responsible for any damages, lost profits, revenues, or
data, financial losses or
indirect, special, consequential, punitive damages, whether arising from or
relating to these T&C,
the Platform, the Platform Content or Third Party Content, or for any
damages related to loss of
revenue, loss of profits, loss of business or anticipated savings, loss of
use, loss of goodwill,
or loss of data, and whether caused by tort (including negligence), breach
of contract, or
otherwise, even if foreseeable and even if we have been advised of the
possibility of such
damages.
Without limiting the foregoing, UWW shall not be responsible for (i) any
damage resulting from a
computer intrusion by a third party leading to a modification of the
information made available on
the Platform, and more generally (ii) any damage, direct or indirect,
whatever the causes,
origins, nature and consequences, caused as a result of anyone's access to
the Platform or
inability to access it, as well as the use of the Platform, (iii) any
damages related to the
functioning of the Internet, (iv) any unauthorized access to or use of our
servers or of any
personal information or data relating to any Users of the Platform, (v)
actions of any third
parties including any platform providers; or (vi) other User’s violation of
these T&C.
No resale of service
You agree not to reproduce, manipulate, duplicate, copy, sell, resell or
exploit for any
commercial or non-commercial purposes, any portion of the Platform, use of
the Platform, or access
to the Platform, without our prior written consent. Should you be interested

duplicating or copying any of the content of the Platform, please contact

Proprietary rights
UWW exclusively owns all legal right, title and interest in and to the
Platform and all materials
and content contained therein, including without limitation, the data, the
logo, any and all
graphics, images, text, files, designs, music, sound, photographs, video,
messages, feeds,
systems, methods, information, computer code, any necessary software used in
connection with the
Platform, scripts, services, marks and branding, the selection and
arrangement thereof, including
all intellectual property and proprietary rights (whether registered or
unregistered in any
jurisdiction) related to any of the foregoing (collectively, the “Platform
Content”). All rights
in and to the Platform and Platform Content not expressly granted to you
under these T&C are
expressly reserved.
The Platform Content contains proprietary information that is protected by
applicable intellectual
property and other laws. We have absolute editorial control over all such
proprietary material. We
grant you permission to view, store, print, reproduce and distribute any
pages or download any
proprietary material for personal non-commercial use only provided that (a)
you do not modify any
such page or any such material; (b) our status (and that of any identified
contributors) as the
authors of the proprietary material is always acknowledged; (c) you include
a link to these T&C
(or, in case of printed material, a printed version of these T&C) with any
reproduction; and (d)
such proprietary information is displayed in accordance with any relevant
requirements as may be
notified to you by us from time to time. Except as expressly authorized by
us or our advertisers,
you agree not to modify, rent, lease, loan, sell, distribute or create
derivative works based on
the proprietary information, in whole or in part.
Trademark and copyright information
UWW, the UWW logo, the emblems of UWW events and other UWW logos and product
and service names are
trademarks and copyright material of UWW (the “UWW Marks”). You agree not to
display or use the
UWW Marks in any manner without our prior written permission.
Intellectual property
The services and their original content, features and functionality are and
will remain the
exclusive property of the UWW.
The services are protected by copyright, trademark, and other laws of both
Switzerland
Termination
We may terminate or suspend your Account immediately, without prior notice
or liability, for any
reason whatsoever, including without limitation if you breach these T&C. You
acknowledge and agree
that we may immediately deactivate or delete your account and all related
information and files in
your Account and/or bar any further access to such files or the Platform.
Further, you agree that
we shall not be liable to you or any third-party in any way for any
termination of your access to
the Platform.
Upon termination, your right to use the service will cease immediately. If
you wish to terminate
your Account, you may simply discontinue using the service.
Miscellaneous
These T&C constitute the entire agreement between Users and UWW with regard
to the use of the
Platform. These T&C supersede all prior representations, understandings,
agreements or
communications between the Users and UWW, no matter the form. UWW shall not
be bound by any term,
condition or other provision which is different from or in addition to the
provisions of these
T&C, including when submitted for instance by and invoice, receipt,
confirmation, correspondence
or other documents.
If any part of these T&C is invalid or unenforceable, these parts will be
construed in a manner
consistent with applicable law to reflect the original intentions of the
parties and the remaining
parts shall remain in force.
A failure by UWW to enforce any provision of these T&C will not constitute a
present or future
waiver of that provision nor limit its right to enforce that provision at a
later time. All
waivers by UWW must be in writing.
All notices or questions on these T&C or use of the Platform must be sent at

Applicable law and jurisdiction
The present T&C are governed by and construed in accordance with the laws of
Switzerland.
Any dispute, controversy, or claim arising out of, or in relation to, this
contract, including
regarding the validity, invalidity, breach, or termination thereof (the
“Dispute”), shall be
resolved by arbitration in accordance with the Code of Sports-Related
Arbitration in force on the
date on which the Notice of Arbitration is submitted in accordance with
those Rules. The number of
arbitrators shall be one. The seat of the arbitration shall be Lausanne,
Switzerland. The arbitral
proceedings shall be conducted in English. Should, for any reason
whatsoever, the subject-matter
of the Dispute be considered by any court as non-arbitrable, then Dispute
shall be subject to the
exclusive jurisdiction of the courts of the Republic and Canton of Geneva,
subject to possible
recourse to the Federal Court in Lausanne.
